IF YOU USED A FINGERTIP-SCAN TIMECLOCK OR HAD YOUR TEMPERATURE TAKEN USING A SCANNER AT MAGID’S FACILITY IN ROMEOVILLE, ILLINOIS BETWEEN JANUARY 8, 2016 AND AUGUST 30, 2024, YOU MAY BE ENTITLED TO PAYMENT OF UP TO APPROXIMATELY $3,244.38 (FINGERTIP-SCAN TIMECLOCK) OR UP TO APPROXIMATELY $135.26 (TEMPERATURE SCAN)

  • A proposed class action settlement has been reached in the case of Bernardo Cardona v. Magid Glove & Safety Mfg. Co., LLC, Case No. 2021 CH 000257, pending in the Circuit Court of Will County Illinois. On August 30, 2024, the Court preliminarily approved the settlement and, by agreement of the parties, certified this lawsuit to proceed as a class action for settlement purposes only. If, between January 8, 2016 and August 30, 2024, you worked at Defendant’s facility in Romeoville, Illinois and used a fingertip-scan timeclock and/or had your temperature scanned, you are a member of the Settlement Class.
  • If you received the notice of the Settlement in the mail, by text message, or by e-mail, our records indicate that you were employed by Defendant at Defendant’s facility or were a temporary worker assigned to Defendant’s facility during the relevant time period. If you are unsure of whether you were an employee or a temporary worker, you may contact the Settlement Administrator for further information. The notice is to advise you of the terms of the proposed Settlement, and your rights in connection with it — here is the notice for temporary workers and here is the notice for employees. The notice contains only a summary of the Settlement Agreement.
  • If you used a fingertip-scan timeclock using a scanner at Magid’s facility in Romeoville, Illinois between January 8, 2016 and August 30, 2024, you are entitled to a payment of up to approximately $3,244.38.
  • If you had your temperature taken using a scanner at Magid’s facility in Romeoville, Illinois between January 8, 2016 and August 30, 2024, you are entitled to a payment of up to approximately $135.26.
  • If you used a fingertip-scan timeclock AND you had your temperature taken using a scanner at Magid’s facility in Romeoville, Illinois between January 8, 2016 and August 30, 2024, you are entitled to both payments.
  • The proposed settlement is not an admission of wrongdoing by Defendant, and Defendant denies that it violated the Illinois Biometric Information Privacy Act or any other law. The Court has not decided who is right or wrong. Rather, to save the time, expense, and distraction of litigation, the Parties have agreed to settle the lawsuit.
  • Please read the Notice carefully. Your legal rights are affected whether you act, or don’t act.

SUBMIT A CLAIM FORM BY NOVEMBER 19, 2024

This is the only way for you to receive benefits from the Settlement, which includes a payment of up to approximately $3,244.38 if you used a fingertip-scan timeclock, and a payment of up to $135.26 if you had your temperature scanned. DO NOTHING

You will be included in the Settlement but receive no benefits. You will be bound by the Court’s judgment of dismissal and be barred from pursuing claims against Defendant and Released Parties relating to the claims in this case.

If you choose to exclude yourself, you will not be included in the Settlement. You will receive no benefits, but you will retain any rights you currently have to pursue legal claims against Defendant.
